These Terms of Service ("Terms") govern your use of the KFE platforms: kfeagritech.co.zw, kfemarket.co.zw, linkszim.co.zw, innovation.kfe.co.zw, and any related services (together, the "Platforms"). By creating an account or using any Platform, you agree to these Terms. If you do not agree, do not use the Platforms.
These Terms are provided in plain language. They form a binding agreement between you and KFE under the laws of Zimbabwe.
1. Eligibility
1.1. You must be at least 18 years old to register for an account. By registering, you confirm you meet this requirement.
1.2. You must provide accurate, current and complete information when registering, including a valid Zimbabwean phone number, and keep it updated.
1.3. You are responsible for all activity under your account and for keeping your password confidential. Notify us immediately of any unauthorised use.
2. What the Platforms do
2.1. The Platforms are marketplaces and listing services. KFE provides the venue; sellers, advertisers and content contributors ("Posters") are independent of KFE.
2.2. KFE does not own, inspect or guarantee the items, services, jobs, scholarships or opportunities listed. Any transaction you enter into is between you and the Poster. KFE is not a party to it.
2.3. Prices, availability and descriptions are the Poster's responsibility and must be accurate and final.
3. Your obligations as a user
3.1. Use the Platforms lawfully and honestly. You must not:
- post false, misleading or fraudulent listings or content;
- post content that is unlawful in Zimbabwe, including content that incites violence or property damage, or that harasses, bullies or defames any person;
- infringe anyone's intellectual property or privacy rights, including posting another person's photo or personal details without their consent;
- upload malware, attempt to breach the Platforms' security, or interfere with other users' use;
- create multiple accounts to evade enforcement, or register on behalf of a child under 18.
3.2. You confirm that any personal data you post about another person (names, phone numbers, photos) is posted with that person's consent.
4. Posters' obligations
4.1. Posters must ensure listings are truthful, with the final price clearly displayed; you may not charge more than the displayed price.
4.2. Posters must honour the Consumer Protection Act [Chapter 14:44], including the 7-day cooling-off right for electronic transactions and the duty to refund in full within 14 days of cancellation where the law requires it.
4.3. Posters must respond to buyer enquiries honestly and fulfil what they advertise.
5. Content moderation and takedown
5.1. KFE may review, hide, edit or remove any content that breaches these Terms or the law, and may suspend or terminate accounts for serious or repeated breaches.
5.2. Notice and takedown: if you believe content on a Platform is unlawful or infringes your rights, contact us at info@kfe.co.zw with the listing link, a description of the issue, and your contact details. We will review and act promptly, including removal where required by law or court order.
5.3. If your content is removed, you may appeal by replying to our notice with an explanation; we will review the appeal fairly.
6. Intellectual property
6.1. You keep ownership of content you post, but you grant KFE a licence to display, store and distribute it on the Platforms as needed to operate the service.
6.2. The Platforms' design, branding and software belong to KFE. Do not copy or reuse them without permission.
7. Fees
7.1. Listing on the Platforms is currently free. If paid services are introduced, their price, billing terms and refund rules will be shown clearly before you pay.
8. Privacy and data
8.1. How we collect, use and protect your personal data is set out in our Privacy Policy at legal.kfe.co.zw/privacy, which forms part of these Terms.
8.2. By registering, you consent to the processing described in the Privacy Policy. Marketing messages are sent only where you have opted in; you may opt out at any time.
9. Liability
9.1. The Platforms are provided "as is". KFE does not promise uninterrupted or error-free operation.
9.2. To the maximum extent permitted by Zimbabwean law, KFE is not liable for losses arising from transactions between users and Posters, or from content posted by users. Nothing in these Terms limits liability that cannot be limited by law, including liability under the Consumer Protection Act.
10. Changes to these Terms
10.1. We may update these Terms. Material changes will be announced on the Platforms and the "Last updated" date revised. Continued use after the changes take effect means you accept them; if you do not accept, stop using the Platforms.
11. Termination
11.1. You may delete your account at any time by contacting us.
11.2. We may suspend or terminate your account for breach of these Terms or unlawful conduct, with notice where practical.
12. Governing law and disputes
12.1. These Terms are governed by the laws of Zimbabwe.
12.2. Disputes will first be addressed through good-faith discussion; failing that, through the courts of Zimbabwe. Consumers also have the right to approach the Consumer Protection Commission.
